Oregon Drug Intervention Plan—Deflection and Conditional Discharge

The Oregon Drug Intervention Plan, enacted pursuant to HB 4002 and 5204 (2024), offers four pathways for qualifying individuals to engage in treatment instead of the traditional criminal process: pre-court diversion (deflection), court diversion (conditional discharge), formal probation supervision, and probation revocation with early release to treatment opportunity.

The Washington County Deflection Program allows eligible persons who are cited or arrested for qualifying charges to avoid prosecution without going to court if they successfully engage in recommended substance use treatment. Deflection is a collaborative program, operated in partnership the Washington County Department of Health and Human Services, Community Corrections, law enforcement, and Behavioral Health Resource Network (BHRN) providers. The Washington County Conditional Discharge Program allows eligible persons who are cited or arrested for qualifying charges to participate in the court process and avoid criminal convictions if they successfully engage in recommended substance use treatment. Conditional discharge is a collaborative program primarily administered by the Washington County Community Corrections Department.
